Service Operator: Fair Share Real Estate Platform (“FairShare”, “we”, “us”, “our”)

This document is a standard Terms & Conditions agreement for the Fair Share application. Please note that while it covers major areas of compliance, it does not replace professional legal advice. Consult a licensed attorney in the UAE before publication.

1) Definitions

  1. Agent: A licensed real estate agent with a valid RERA license in Dubai who creates and manages an account on FairShare.

  2. Listing: Any real estate record created and published on FairShare. Only agents can create listings.

  3. Subscription Plan: Paid access levels (1-month, 6-month, 12-month) that unlock certain platform features.

  4. Payment Provider: Third-party services (such as PayPal) that process subscription transactions.

  5. Jurisdiction: Dubai, United Arab Emirates. Governing law and competent courts as defined in Section 21.

2) Eligibility

  1. Registration and use of FairShare is strictly limited to licensed real estate agents.

  2. Individuals or entities without a valid RERA license may not register or use the service.

  3. We reserve the right to request verification of licenses at any time. Accounts failing verification may be suspended or terminated.

3) Account Creation and Security

  1. Agents must provide accurate and complete information during registration.

  2. You are responsible for maintaining the confidentiality of your account credentials.

  3. You agree to notify us immediately of any unauthorized use of your account.

4) Role of FairShare

  1. FairShare is a technology platform only.

  2. We do not act as a real estate broker, financial advisor, escrow agent, or mediator.

  3. All transactions and negotiations are conducted directly between users, outside of the platform, and at their own risk.

5) Listings

  1. Only agents may create listings.

  2. Listings must be accurate, lawful, and comply with UAE real estate regulations (including RERA requirements).

  3. Misleading, false, or fraudulent content is strictly prohibited.

  4. We may remove or suspend listings that violate these terms or UAE law.

6) Visibility Options

  1. Listings may be shared as Public, Colleagues, Group, or None.

  2. Visibility is fully controlled by the listing owner.

  3. FairShare is not responsible for the consequences of an agent’s chosen visibility setting.

7) Matching and Notifications

  1. The platform uses automated algorithms to match listings.

  2. We do not guarantee the accuracy or success of any match.

  3. Notifications may be sent to other agents based on listing visibility and matching criteria.

8) In-App Messaging

  1. Messaging must remain professional, respectful, and compliant with UAE law.

  2. Spam, harassment, or discriminatory content is prohibited.

  3. We may monitor communications for compliance and safety.

9) Artificial Intelligence Features

  1. AI features (e.g., auto-fill descriptions) are provided for assistance only.

  2. Agents remain fully responsible for reviewing and validating any AI-generated output.

  3. FairShare is not liable for errors or omissions in AI-generated content.

10) Subscriptions and Payments

  1. Certain features require a paid subscription plan.

  2. Fees, duration, and benefits are clearly stated at the time of purchase.

  3. All payments are processed through in-app purchase systems: Google Play Billing on Android and Apple In-App Purchase (non-renewing subscriptions) on iOS. We do not store any payment card or banking information.

  4. If you purchase a new plan while an active subscription exists, the new period is added to the end of the current subscription.

  5. Refund Policy: Subscriptions are non-refundable once activated, unless otherwise required by UAE law.

  6. Promotional codes or discounts may be offered. They are non-transferable and subject to their own conditions.

11) Prohibited Conduct

Users may not:

  • Share accounts or transfer access without authorization.

  • Circumvent security measures, use bots, or scrape data.

  • Collect other agents’ information for spam or marketing without explicit consent.

  • Upload malware, infringing, or unlawful content.

12) Intellectual Property

  1. All rights to the platform, its design, and source code belong to FairShare or its licensors.

  2. By uploading content, you grant us a non-exclusive, royalty-free license to host and display it.

  3. Removal of content does not prevent us from retaining backup copies for legal or operational purposes.

13) Compliance with UAE Law

  1. Agents must comply with Dubai Land Department and RERA regulations at all times.

  2. We are not responsible for verifying the validity of licenses but may suspend accounts upon credible reports of non-compliance.

  3. Agents are solely responsible for ensuring their marketing practices comply with UAE real estate advertising laws.

14) Third-Party Content and Links

We may display third-party content or links. We are not responsible for the accuracy or legality of such content.

15) Availability and Updates

  1. Service availability may be interrupted for maintenance or events beyond our control.

  2. Features may change or be discontinued at any time.

  3. Beta features are provided “as-is.”

16) Disclaimers

  1. The service is provided “AS IS” and “AS AVAILABLE.”

  2. We make no warranties about accuracy, uptime, or outcomes of using the platform.

  3. Use of the service is at your own risk.

17) Limitation of Liability

To the extent permitted by UAE law:

  1. We are not liable for indirect, incidental, or consequential damages.

  2. Our maximum liability is limited to the total fees paid by you in the three (3) months prior to a claim.

18) Indemnity

You agree to indemnify and hold FairShare harmless against any claims, damages, or expenses arising from your use of the platform, your listings, or your violation of these Terms.

19) Suspension and Termination

  1. We may suspend or terminate any account that violates these Terms, UAE law, or poses security risks.

  2. You may close your account at any time. Certain data may be retained as required by law.

20) Governing Law and Dispute Resolution

These Terms are governed by the laws of Dubai, United Arab Emirates. Any disputes shall be resolved exclusively in the competent courts of Dubai.

21) Modifications

We may update these Terms from time to time. Continued use of FairShare after updates constitutes acceptance of the revised Terms.

22) Notices

We may send notices via email, in-app notifications, or announcements on the platform. You are responsible for reviewing such communications.

23) Miscellaneous

  1. Severability: If any provision is invalid, the remaining provisions remain in effect.

  2. Assignment: You may not transfer your rights or obligations without our prior written consent.

  3. Entire Agreement: These Terms constitute the complete agreement between you and FairShare.

  4. Force Majeure: We are not responsible for delays or failures due to events beyond our reasonable control.
